If you hold an H-1B visa in the United States, Canada may be about to open a new door for you. The federal government has signalled plans to launch an accelerated H1B visa holder work permit pathway. With the U.S. H-1B registration season opening on March 4, 2026, a Canadian announcement could come soon.

Although there’s no clarity on when this program will open and what the application process will look like, those who are prepared may have an advantage, especially since the application window closed in 48 hours in 2023. Canada’s 2023 H-1B Work Permit Program: Looking Back

In July 2023, as part of Canada’s first Tech Talent Strategy, the federal government launched an open work permit stream specifically for H-1B specialty occupation visa holders living in the United States. The program didn’t require a Canadian job offer. Approved applicants received an open work permit valid for up to three years, meaning they could work for any employer, anywhere in Canada.

Spouses and common-law partners of successful applicants were also eligible to apply for work or study permits, and dependent children could accompany the principal applicant to Canada.

The response was overwhelming. The program opened on July 16, 2023, and by the end of July 17, all 10,000 application spots had been filled. The window was just wide enough for those who had their documents ready.

The Current Context: Canada as an Alternative to the U.S. 

In the last year, the U.S. immigration landscape for H-1B holders has shifted significantly. In September 2025, the Trump administration announced a $100,000 fee for certain new H-1B visa petitions. While it was later clarified that most existing H-1B holders and in-country renewals would be exempt, the move led to uncertainty among employers and workers navigating an already complex process. Moreover, the Trump administration has been vocal about restricting immigration, which has made foreign workers in the U.S. unsure about their long-term prospects.  

Meanwhile, Canada has made its intentions clear. In a November 2025 speech, Prime Minister Mark Carney announced that Canada will “implement a targeted program to attract talented U.S. H-1B visa holders.” 

The 2025 federal budget, too, mentioned an accelerated pathway for H1-B visa holders to “strengthen Canada’s innovation ecosystem, address labour shortages and attract top talent in healthcare, research, advanced industries and other key sectors.” 

Why March 2026 Might Be Significant 

The U.S. H-1B registration season for 2027 opens on March 4, 2026. This is the period when U.S. employers submit registrations for the annual H-1B lottery on behalf of workers they want to hire or retain. 

It’s a moment when H-1B uncertainty is top of mind for hundreds of thousands of workers in the United States. That makes it a great window for Canada to announce a competing pathway that positions the country as a stable alternative. 

There’s no guarantee this will happen in March, but being prepared will give you a significant headstart if it does. 

How to Prepare for an H-1B Visa Holder Work Permit in 2026 

The single biggest lesson from the 2023 Canada Tech Talent Strategy is that speed matters. With 10,000 H-1B visa holder work permit spots filling in under 48 hours, applicants who had their documents organized and ready to submit were the ones who got in. If a new program launches with a similar cap, being prepared could make the difference between applying and missing out. 

Even before any official announcement, make sure you have your H-1B documents ready. Based on what was required in 2023, you’ll likely need: 

  • A copy of your current H-1B specialty occupation visa 
  • Form I-797 or I-797B (Notice of Action). This is the letter from USCIS confirming your approved H-1B petition 
  • Proof that you live in the United States, such as a Form I-94 (Arrival/Departure Record), a recent utility bill, or a U.S. income tax document 
  • Digital copy of your passport (all pages). If your passport is set to expire within the next three years, renew it now so you can get a full three-year work permit. 
  • Civil status documents (such as a birth certificate or marriage certificate) 
  • Proof of financial stability 
  • A digital photo that meets IRCC specifications 

Make sure these documents are current and easily accessible. If any have expired or need updating, start that process now. 

What To Do Next as an H-1B visa Holder 

The accelerated pathway for H-1B visa holders hasn’t opened yet, so there’s nothing to apply for right now. If you’re a foreign worker in the U.S., and are looking to move to Canada, the most productive thing you can do at this stage is prepare so that when an announcement does come, you’re ready to act. If the program includes an application cap like last time, we expect extremely high demand and a narrow application window. 

  • Start by gathering the H-1B status documents listed above.  
  • Make sure your documents are in English or French (or get a certified translation).  
  • Check the expiry date for your passport and renew it if needed.  
  • Keep an eye on IRCC’s official channels for program announcements.  

The government has said the pathway will launch “in the coming months,” and given the political momentum behind this initiative, an update could come at any time. 

What We Know About The H-1B Holder Work Permit Program 

Here’s what we know about the upcoming H-1B visa holder work permit pathway. Bear in mind that many of the details below are based on how the 2023 program worked, and the new pathway may differ. But this should give you a reasonable starting point for what to expect. 

Who is Likely to Qualify for an H-1B Visa Holder Work Permit? 

In 2023, the program was open to anyone with a valid H-1B specialty occupation visa who was living in the United States. There were no additional requirements around specific occupations, industries, or salary levels.  

The 2025 budget language mentions healthcare, research, and advanced industries as target sectors, so the new pathway may be more focused — but this hasn’t been confirmed. 

Will I Need a Canadian Job Offer to Qualify For an H-1B Visa Holder Work Permit? 

The 2023 program did not require a job offer. Successful applicants received an open work permit, meaning they could work for any employer in any occupation across Canada, with a few exceptions. Whether the new pathway follows the same model or requires a job offer remains to be seen. 

How Long Would the Work Permit Be Valid? 

Under the 2023 Canada Tech Talent Strategy, the open work permits issued were valid for up to three years. However, if your passport expired before the three-year mark, the permit was only valid until your passport’s expiry date. Extensions were not available.  

This is why renewing your passport well in advance is one of the most important preparation steps. A passport valid for at least four years was recommended to account for processing time. 

Can My Spouse and Children Come With Me? 

Yes, in 2023, spouses and common-law partners could apply for their own work or study permits, and dependent children could accompany the principal applicant. The permits for family members were valid for the duration of the principal applicant’s open work permit. It’s reasonable to expect a similar arrangement under the new H-1B visa holder work permit program, though this hasn’t been confirmed. 

How Much Will It Cost to Apply for an H-1B Visa Holder Work Permit? 

Currently, all work permits have a processing fee of $155 CAD. Assuming that the H-1B visa holder work permits are open work permits (like last time), you will also need to pay an open work permit holder fee of $100. 

Applicants who have not previously given biometrics to enter Canada also need to pay an $85 CAD biometrics fee. 

Will There Be a Cap on H-1B Holder Work Permit Applications in 2026? 

The 2023 pilot had a cap of 10,000 applications, which was reached in under 48 hours. Whether the new program will have a cap — and if so, how large — is one of the most important unknowns. If a cap is in place, having your documents ready before the program opens will be critical. 

What Will Happen After I’m Approved For an H1B Visa Holder Work Permit? 

Once an application is approved, applicants receive a port of entry letter confirming they are authorized to work in Canada. They can then present this letter, along with their supporting documents, at a Canadian border crossing to be issued the physical work permit. 

Accelerated Pathway for H-1B Holders: What We Don’t Know Yet 

As of March 3, 2026, no official program details have been released by Immigration, Refugees and Citizenship Canada (IRCC). Key questions that remain unanswered include: 

  • When will the program launch? 
  • Will it offer open work permits like last time? Or can we also expect a direct path to permanent residence? 
  • Will there be an application cap? If so, how many spots? 
  • What eligibility criteria will apply (specific occupations, sectors, or experience requirements)? 
  • What will the application process look like? 
  • Will family members be able to apply alongside the principal applicant? 

Until IRCC publishes an official update, the structure and timing remain unconfirmed. That said, the government’s public statements suggest this is a matter of when, not if.
